TERMS & CONDITIONS

1. Presentation and definitions

This site is owned, maintained and operated by MACOM MALHAS DE COMPRESSAO LTDA, hereinafter referred to as Macom, with address at RUA ANTONIO LAPA 618, CAMBUÍ - CAMPINAS/SP, registered with the CNPJ/MF under no. 59,257,493/0001-92.

This document lists the terms and conditions that must be observed by Macom and Users (as defined below) when using the Site, its tools and its functionalities. Macom provides access to and use of the Site to any User. The User declares to have read and accepted these Terms and Conditions of Use and Policies before starting to use the Site. If the User does not accept these Terms and Conditions of Use, he will not be allowed access to restricted areas of the Site, nor will he be allowed to purchase products.

For the purposes of these Terms and Conditions of Use, as well as the Policies, the terms below shall have the following meanings:

CALL CENTER - customer service provided by Macom via email and telephone;

Customers - users who filled out the registration form and have an Access Account;

Purchase - transaction whereby a Customer acquires a product offered for sale on the Site, upon payment of the value of the product;

Access Account - credential defined by the user name (login) and password of a registered visitor (Customer), personal and non-transferable, which allows access to the restricted area and exclusive functionalities on the Site, such as access and alteration of private data, prices of products, orders for products, among others;

Users - any person accessing the Site, including anonymous visitors and Customers.

2. Rules for using the Site

The User undertakes to use the Site respecting and observing these Terms and Conditions of Use, as well as current legislation, customs and public order. In this way, the User agrees that he may not:

(i) harm the rights of third parties, regardless of their nature, at any time, including during the use of the Site;

(ii) perform acts that limit or prevent access and use of the Site, under appropriate conditions, to other Users;

(iii) unlawfully access the Site or computer systems of third parties related to the Site or Macom in any way or form;

(iv) disseminate computer programs or viruses capable of causing damage of any nature, including equipment and systems of Macom or third parties;

(v) use mechanisms other than those expressly enabled or recommended on the Site to obtain information, content and services;

(vi) carry out any acts that in any way may cause any loss or damage to Macom or other Users;

(vii) access programming areas of the Site, databases or any other set of information that escapes the public or restricted areas of the Site;

(viii) reverse engineer or allow to reverse engineer, translate, modify, alter language, compile, decompile, modify, reproduce, rent, sublease, disclose, transmit, distribute, use or otherwise dispose of the Site or the tools and functionality made available therein under any means or form, including in a way that violates Macom's rights (including Macom's Intellectual Property) and/or third parties;

(ix) practice or participate in any act that constitutes a violation of any right of Macom (including Macom's Intellectual Property) or of third parties or any applicable law, or act in any way or manner that may contribute to such violation;

(x) interfere with security or commit undue use against the Site or any resource of the system, network or service connected or that can be accessed through the Site, accessing the Site only for lawful and authorized purposes;

(xi) use Macom's domain to create links or shortcuts to be made available in unsolicited emails (spam messages) or on websites of third parties or the User's own or, even, to carry out any type of action that may harm Macom or third parties;

(xii) use automated data collection and selection applications to carry out mass operations or for any purpose, or even to collect and transfer any data that may be extracted from the Site for unauthorized or unlawful purposes;

(xiii) use the tools and features of the Site to disseminate messages unrelated to the Site or the purposes of the Site, including messages of a racist, ethnic, political, religious, cultural or derogatory, defamatory and/or libelous nature of any person or social group.

The User agrees to indemnify, defend and hold Macom harmless from any claim, notice, subpoena or judicial or extrajudicial action, or from any liability, damage, cost or expense arising from any violation and/or infraction committed by the User or any person acting on your behalf, with your consent or tolerance, in relation to the Site (including in relation to any provision of these Terms and Conditions of Use), including any person who has obtained User data related to your Access Account or your navigation on the Site.

Macom may, at its sole discretion, block, restrict, disable or prevent access by any User to the Site, in whole or in part, without prior notice, whenever inappropriate conduct by the User is detected, without prejudice to administrative, extrajudicial measures and legal proceedings that it deems appropriate.  

3. Customer Registration

In order to gain access to the complete content and to all the tools and functionalities of the Site, including the possibility of making Purchases, the User must create an Account with personal and company data, which will be stored and used to identify Purchases, to be used under the terms of the Privacy and Security Policy, emphasizing that the creation of each Account assumes express consent to the collection, use, storage and processing of personal data by Macom and/or by third parties contracted by Macom to carry out any related procedure or process Purchasing, including payment processing, deliveries, returns, etc.

Each Customer is allowed to create only one Access Account and Macom reserves the right to suspend or cancel any duplicate Access Accounts.

Upon completing his Access Account, the Client declares that the information  provided is complete, true, current and accurate, being the Client's sole responsibility to update his Access Account data whenever necessary. change of name, corporate name, address or any other relevant information.

Macom may refuse, suspend or cancel a Customer's Access Account whenever it suspects that the information provided is false, incomplete, out of date or inaccurate or even in the cases indicated in the applicable laws and regulations, in these Terms and Conditions or in any Policy of the Site, even if previously accepted.

The Client, when creating his registration, will determine his username and password. It is the sole responsibility of the Client to maintain the secrecy of the username and/or access password relating to his Access Account, and the Client must immediately notify Macom in case of loss, disclosure or theft of the password or even of unauthorized use. authorized from your Account. Minors (under 18 years of age) will not be able to use the Site, unless they are represented and/or assisted by their parents or legal guardians and authorized by them at the time of creating the Account. The creation of an Account in the name of a minor presupposes the representation of this minor by a person over 18 years of age, who will be considered civilly and criminally responsible for any Purchase made, violation committed or false, incomplete, outdated or inaccurate statement provided by the minor. 18 years.  

4. Private data, privacy and security

All information or personal data provided by the User to the Site is stored on high security servers or magnetic means.

Macom will take all possible measures to maintain the confidentiality and security described in this clause, but will not be liable for damage that may be derived from the violation of these measures by third parties that use public networks or the internet, subverting security systems to access user information.

5. Product offer

Macom will make available on the Site, for each product, a descriptive page, which will contain information regarding its characteristics, composition, payment terms and total cash price. The Site makes products available for orders only within the national territory.

6. Stock

Macom has a large number of items registered on the Site. For reasons beyond Macom's will and control, it is possible that some of these items may be temporarily unavailable, due to peculiarities, seasonality or problems in the supply chain. Macom undertakes to use its best efforts to maintain the availability of as many items as possible.

 

7. Credit and Payment

The Customer is aware and authorizes Macom to carry out its credit analysis, being able to consult any of the existing credit protection entities in Brazil and, for that purpose, to inform such entities of the requested data, such as_cc781905-5cde-3194-bb3b- 136bad5cf58d_ name, CPF, corporate name or CNPJ and other information requested.

The delivery of the goods requested on the Site is the exclusive responsibility of Macom, after the User's credit analysis.

Payment is made directly to Macom, through a bank slip, according to the period selected by the Customer at the time of purchase on the Site. Still according to the result of the credit analysis, Macom reserves the right to change the payment term, informing the Customer.

 

8. Price

The Site presents prices valid only for purchases completed online, with delivery in the territory in which Macom offers delivery. In such prices, all applicable taxes are already accounted for, excluding only freight costs, which will be included at the time of completion of the Purchase, according to the Customer's decision for CIF or FOB freight.

Macom reserves the right to revise, improve, modify and/or update the prices practiced by the Site, meeting criteria of need, convenience or market fluctuations, without the need for prior notice.

9. Purchase Follow-up

In addition to sending emails informing the most important changes in the processing and delivery of a Purchase, Macom provides an area on the Site that allows Customers to follow the status of their purchase step by step. If in doubt as to the situation presented by the tool, the Customer may contact Macom through the service channels available on the Site.  

10. Delivery

The average delivery time for products purchased on the Site is up to 7 business days from the date of issue of the order, however, it may vary depending on the delivery region, the type of shipping chosen by the Customer, the carrier chosen by the Customer and availability in stock of ordered products.

In case of delay in delivery, Macom will contact the Customer, informing a more precise deadline.

The deadline may also vary according to the Customer's credit analysis for each order, which will also be communicated by Macom to the Customer.

11. Regrets, exchanges and returns

The Customer, within a period of 07 (seven) days, may withdraw from the purchase, counting from the receipt of the product(s) purchased on the Site. In this case, the packaging of the product must be intact, otherwise the return will not be accepted, and the shipment must be made directly to the address indicated by Macom. Shipping expenses, in the event of withdrawal, must be paid by the Customer or deducted from any reimbursement to which they are entitled.

The cancellation of the order will be carried out after analysis of the product by Macom. The analysis will be carried out within 15 (fifteen) business days, counting from the receipt of the product.

If the product meets the above requirements and the order has already been paid, the refund of the amount will be according to the payment options below:

- Bank slip: the refund will be made through a deposit into the current account of the purchaser, with the same CPF, within 30 (thirty) business days.

If the product meets the requirements and the order has not yet been paid, Macom will cancel the due payment slip(s).

In case of model divergence, the Customer must check the product together with the carrier, at the time of delivery. If there is any discrepancy with the product or the quality of the delivery, you must refuse and record the reason for the return on the back of the invoice.

As soon as communicated by the carrier, Macom must provide a new order with the shipment of the product.

If the Customer receives the product and it presents some discrepancy, it is necessary that the good is without signs of use, accompanied by an invoice, manual and all its accessories so that the replacement can be made with another product of the same type (model and brand ).

The collection of the product or shipment to the Supplier must be agreed between them, the Customer and Macom.

If the product is out of stock, it may be replaced by another similar product at the same price. However, if the Customer does not want to receive the similar product, he will have the right to request the cancellation of the purchase and will be entitled to reimbursement of the amount paid, if this has been done in advance.

Macom will not be obliged to cancel, repair or replace any product that shows signs of misuse or that has been disassembled.

12. Responsibilities

Macom engages its best efforts to inform, serve and protect the User. The User is solely responsible for the use of the Site, its tools and functionalities.

Under no circumstances will Macom or its directors, representatives, agents, employees, partners, partners or service providers be liable for any emergent, indirect, punitive or expiatory damages, lost profits or other monetary damages related to any claim, lawsuit or other procedure taken in relation to the use of the Site, its content, functionalities and/or tools.

Notably, Macom's liability for the following circumstances, among others, is excluded:

(i) damages that the User may experience due to the unavailability or partial functioning of the Site and/or all or some of its services, information, content, functionality and/or tools, as well as the inaccuracy or inaccuracy of any of these elements;

(ii) damages that the User may experience on internet sites accessible through links included on the Site;

(iii) price differences between the items made available on the Site and those displayed for sale on other sites that sell Macom products or those of any company of the economic group of;

(iv) damages that the User may experience as a result of using the Site in violation of these Terms and Conditions of Use;

(v) damages that the User may experience as a result of using the Site in violation of the law, customs or public order;

(vi) damages that the User may experience as a result of failures on the Site, including failures in the system, server or network connection, or even malicious interactions such as viruses, software that may damage equipment or access information of the User's equipment;

(vii) damages that the User may experience as a result of distortions that the product images may present, emphasizing the merely illustrative character of such images; among others. 

13. Internet applications or computer viruses

Due to technical difficulties, Internet applications or transmission problems, inaccurate or incomplete copies of the information contained on the Site may occur. Computer viruses or other harmful programs may also be inadvertently downloaded from the Site. Macom will not be responsible for any application, computer virus or other harmful or invasive files or programs that may harm or affect the use of the computer or other property of the Users due to access, use or navigation on the Site, or even for the download of any material contained therein, recommending the installation of antivirus applications or suitable protectors.  

14. Intellectual Property Rights

The User is not authorized to use, in any form or pretext, the Macom name and/or logo, its partial or complete reproductions or even its imitations, regardless of the purpose of such use.

The User undertakes not to challenge the validity of any brand or any other distinctive sign deposited or registered by Macom or by any companies linked to it, in any way, in Brazil or abroad.

All content on the Site - including the domain name [www.macomcintas.com.br], programs, databases, files, texts, photos, layouts, headers and other elements - was created, developed or assigned to Macom, is owned by Macom or licensed to it and is protected by Brazilian laws and international treaties that deal with intellectual property rights.

The User, when accessing the Site, certifies that he will respect the existence and extent of Macom's Intellectual Property rights, as well as all third-party rights that are used, in any capacity, on the Site or that may be made available on the Site. .

15. Customer Service

Macom provides a Call Center to receive all communications that the User wishes to make:

(a) By phone (19) 2660-2571, Monday to Friday from 8:00 am to 5:30 pm;

(b) By correspondence addressed to Macom, RUA ANTONIO LAPA 618, CAMBUÍ - CAMPINAS/SP;

(c) Through the form for sending messages, on the Contact Us link on the Site.
